MAZE …

... I don’t know about you, but sometimes a perspective  by an “outsider” on a topic about which I am passionate only serves to heighten my “push-back” … fortunately for me and I believe those who attended the recently concluded facilitated workshop conducted by Jim and Dave, on Monday and Tuesday 4th and 5th of February 2013 at ADEQ in Phoenix … very respectfully they shed light on what has evolved into obstacles – unintended consequences – but obstacles nonetheless in our current ADEQ onsite rules …

Just getting their fresh perspective on defining … PERFORMANCE vs PRESCRIPTIVE … colors quite differently our current ADEQ onsite rules …

For me, their perspective, set a tone challenging many current underpinnings of our current ADEQ residential onsite rules … Not suggesting that we automatically throw the baby out with the bath water but we at least be honestly willing , as one option, to consider that route …

As one who contributed to the initial 2001 – ADEQ Unified Permit Rule which morphed into our current residential onsite rules,  though we thought our effort was reality and science based, increasingly it is evident – exposed to light by input from folks like Jim and Dave – big chunks of our current rule is based on nothing more than WAG and in light of current wastewater knowledge is functionally obsolete if not outright – wrong …

For me, what became painfully obvious, during the workshop, has been our steadfast unwillingness in rule to authentically hold anyone ACCOUNTABLE … we have as many are aware front end loaded rules, equally thought by many to be very prescriptive and noted to be based on protecting surface water (drinking water/EPA) …

Moreover it is suggested our rule is loaded with SAFETY factors, though at the moment, we have not made any effort to clearly delineate them … if that is an undertaking we accept, it would be advisable for us to also consider those topics affecting SAFETY devoid in our rule … ie … clear, concise, understandable … education … training … O&M … reporting … enforcement … funding … the lack of any ONE of which also equally affect SAFETY

If I may and I trust I do reasonable justice to her … I was forcibly struck by a sincere and respectful query from Kitt near the close of the facilitation wherein she asked … in essence … for whom are our residential onsite rules promulgated and what is our mission statement going forward in this process …

It strikes me that unless we can attain, an equally sincere and respectful consensus on Kitt’s query and reduce it to a clear, concise understandable statement our informal rule development process will miss a golden opportunity …

I offer merely as a point for consideration that our mission statement encompass and reflect … do no harm

All I can say is those who were unable to attend the facilitation you missed out on an occasion to attain a new level of AWARENESS in a non-confrontational environment …
